USCIS Introduces Asylum Fee
As of April 1, 2024, USCIS is requiring an “asylum fee” to accompany each I-129 or I-140 filed to allow foreign nationals to work in the U.S. The asylum fee is $600 if the US petitioning entity has 26 or more employees. The asylum fee is $300 if the US petitioning entity has 25 or fewer employees or is a non-profit organization. EB-1 self petitioners pay the reduced $300 asylum fee. The asylum fee will go toward hiring and training more officers to adjudicate the backlog of asylum applications currently pending. This new fee is accompanied by an increase in the filing fee amounts required to submit I-129 (O-1) petitions, as well as I-140 (EB-1 green card).
USCIS Announced Deferred Enforced Departure Work Authorization for Palestinians
On April 12, 2024, USCIS announced that Deferred Enforced Departure (DED) Employment Authorization Documents (EAD's) will be available to Palestinians who were in the United States on or before February 14, 2024. The deferment will allow Palestinians to remain in the U.S. with work authorization through Aug. 13, 2025. You can read more about the process HERE.
EAD Renewal Extensions Are Extended "Again"
On April 4, 2024, USCIS announced the automatic extension period for employment authorization and work permits of certain renewal applicants from 180 days up to 540 days.
Historically, when an applicant applied to renew his or her Employment Authorization Document (aka EAD or Work Permit), the applicant’s work authorization would be automatically extended for 180 days. In May 2022, USCIS increased the period of automatic extension of EAD’s from 180 days to 540 days. Then in October 2023 USCIS rolled it back and reinstated the 180 day extension period. Now, as of April 4, 2024, eligible EAD extensions will again be extended for 540 days.
Medical Exams Will Not Expire
USCIS issued a new rule in April 2024 stating that all medical exams completed after November 1, 2023 will not expire and can be used indefinitely. You can read more HERE.
EB-1 Priority Dates
In May 2024, EB-1 priority dates for citizens of India and China remain the same as last month. For citizens of India the EB-1 priority date remains at April 1, 2021. For citizens of China the EB-1 priority date remains at January 1, 2023.
